Welcome to the Aura App! These Terms of Use (“Terms”) form a binding legal agreement between you and Jupiter Technologies LLC (“Company,” “we,” “our,” or “us”) regarding your use of our mobile applications, websites, and services (collectively, the “Services”).
By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree, you must discontinue use of the Services.
1. Accounts
By creating an account, you agree that:
You must provide accurate, complete, and up-to-date information.
You are responsible for safeguarding your login credentials and all activity under your account.
You confirm that you are at least 13 years old (or older if required by your jurisdiction). If you are a minor, you must have parental or guardian consent.
We may refuse, suspend, or terminate accounts that violate these Terms.
2. Privacy
Your privacy is important to us.
Our practices for the collection, use, and protection of personal information—including facial images, wellness inputs, and Apple Health data—are described in our Privacy Policy, which is incorporated by reference.
Do not use the Services or provide personal information if you are under 13.
3. Messaging & Notifications
By creating an account, you consent to receive:
Administrative notifications (e.g., security alerts, account updates)
Transactional messages
Optional marketing communications (which you may opt out of via settings or email)
Certain service-related notifications may still be delivered even if marketing opt-out is selected.
4. Acceptable Use
You agree that you will not:
Violate laws, regulations, or industry guidelines (including Apple Developer Policies).
Upload or share harmful, offensive, unlawful, or misleading content.
Attempt to bypass, disable, or interfere with security features.
Reverse engineer, copy, or misuse the Services or underlying technologies.
Engage in fraudulent, abusive, or unauthorized use of AI features or HealthKit connections.
Violations may result in suspension or termination of your access.
5. Use of AI, Face Scanning, Hair Analysis, and Wellness Features
Aura provides insights using computer vision and machine learning models to analyze:
Hair and scalp images
Haircare product inputs
Lifestyle and wellness information
(If enabled) Apple Health data
You acknowledge and agree that:
Aura’s analysis is for informational and wellness purposes only.
The Services do not perform identity matching, or biometric authentication.
Recommendations, scores, and insights are estimates based on visible attributes and user-provided data.
Results may vary and are not guaranteed.
Aura is not a medical device and does not diagnose, treat, cure, or prevent any disease.
6. HealthKit and Wellness Data
If you choose to connect Apple Health:
HealthKit data is used only to enable wellness tracking, insights, and habit recommendations.
HealthKit data will never be used for advertising, data mining, or sale to third parties.
You may disconnect HealthKit at any time in Apple’s Health settings.
You are responsible for ensuring Health data permissions are correct and up to date.
By enabling HealthKit, you grant us permission to read the data types you approve and process them as described in our Privacy Policy.
7. Content & Ownership
All software, features, design, graphics, and content in the Services are owned by or licensed to Jupiter Technologies LLC and protected by intellectual property laws.
You retain ownership of any content you submit (e.g., uploaded routines, product lists, wellness logs), but grant us a limited, worldwide, royalty-free license to use it solely to operate and improve the Services.
You may not:
Copy, distribute, or modify the Services or content.
Use the Services for any commercial purpose without our written permission.
8. Third-Party Services
The Services may include links to or integrations with:
Retailers (e.g., Sephora, Amazon)
Product catalogs and APIs
Analytics or hosting providers
Apple HealthKit
Other third-party tools
We are not responsible for third-party content or practices.
Your interactions with third parties are at your own risk.
9. Paid Services & Subscriptions
Some parts of the Services include paid features or subscriptions.
Payments are processed by the Apple App Store or Google Play Store.
Fees are non-refundable unless required by law or store policy.
Subscriptions may auto-renew unless canceled in your app store account settings.
We are not responsible for billing errors caused by app store providers.
Prices may change, but you will be notified if required by applicable law.
10. Termination
You may stop using the Services at any time.
We may suspend or terminate your account if:
You violate these Terms
Your actions threaten the integrity, security, or legal compliance of the Services
Required by law or regulatory reasons
Upon termination:
Your access may immediately cease
Certain sections (e.g., Disclaimers, Limitation of Liability, Indemnification) survive termination
11. Disclaimers
The Services are provided “as is” and “as available”.
We do not guarantee:
Accuracy of AI-based insights
Medical reliability
Error-free operation
Specific results from skincare, haircare, or wellness routines
Aura provides general wellness information, not medical advice.
You agree:
The App does not diagnose or treat medical conditions
You should consult a licensed professional for medical, dermatological, or trichological concerns
Apple may require this disclaimer for apps using face-scanning or HealthKit data.
12. Limitation of Liability
To the fullest extent permitted by law:
Jupiter Technologies LLC will not be liable for indirect, incidental, special, or consequential damages.
Our total liability will not exceed the amount you paid in the 12 months preceding the claim.
Some jurisdictions do not allow certain liability limitations, so some parts may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless Jupiter Technologies LLC, its affiliates, and employees from:
Claims
Damages
Losses
Liabilities
Legal fees
arising from your misuse of the Services or violation of these Terms.
14. Governing Law & Dispute Resolution
These Terms are governed by the laws of Delaware, United States.
Disputes will be resolved through binding arbitration in New York City, NY.
You waive:
The right to a jury trial
The right to participate in class actions
You may opt out of arbitration within 30 days of first accepting these Terms by emailing hello@jupiterwellness.co.
15. Miscellaneous
If any provision is deemed invalid, the remaining terms remain enforceable.
These Terms represent the entire agreement between you and us.
We may update these Terms periodically; continued use constitutes acceptance of the updated version.
